Please read these terms carefully before using our services.

1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of Pebble Animation's website and animated video creation services (collectively, "Services"). By accessing our website, creating an account, placing an order, or using any of our Services, you ("Customer," "you," or "your") agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services. Pebble Animation ("we," "us," "our," or "Company") reserves the right to modify these Terms at any time. Changes become effective upon posting to our website. Your continued use of our Services constitutes acceptance of modified Terms. If you do not accept changes, you must stop using our Services.
2. Description of Services
Pebble Animation creates custom animated video content for social media and advertising purposes. Our standard service includes: • Creation of one custom animated video, in the length selected at checkout (30, 45, or 60 seconds), based on information you provide • Video delivery in your choice of vertical (9:16), horizontal (16:9), or square (1:1) format • Professional voiceover and caption overlay (English language) • One finished, ready-to-post version delivered captioned and with voiceover • Branding and styling matched to your specifications using your provided assets • One round of revisions per video (defined as minor adjustments to color, text, pacing, or voiceover emphasis) • Delivery via secure download link within 48 hours of order placement (time frames are estimates and not guaranteed) Custom services, bulk orders, or special requests are available by quote and require a separate written agreement.
3. Pricing and Payment
Our pricing is displayed clearly at checkout: • Per-Video Orders: $125 for a 30-second video, $165 for 45 seconds, or $190 for 60 seconds. Payment is due in full at the time of order placement via credit card or other accepted payment method. All orders are one-time purchases. We do not offer subscriptions and nothing you buy renews or recurs. Prices are subject to change with notice. Any price changes apply to future orders only, not retroactively to orders already placed. Applicable taxes will be calculated and added at checkout. We accept major credit cards and other payment methods as displayed on our website. Payment is processed by third-party payment providers; your payment information is subject to their terms and security policies, not solely our control.
4. Refund Policy — No Refunds
Pebble Animation does not offer refunds for any reason, including: • Dissatisfaction with the creative direction or final video • Changes to your business needs or project scope after ordering • Failure to provide necessary information or assets on time • Overpayment or duplicate charges (which will be handled as credits toward future services, not refunds) The only exception is if Pebble Animation fails to deliver any video at all due to our own error. In such case, we will either re-deliver the video or issue a credit toward a future order. We do not offer cash refunds; all remedies are limited to service credits or re-delivery. If you have a legitimate concern about a delivery failure or technical issue, please contact us immediately at hello@pebbleanimation.com within 7 days of your delivery date.
5. Revisions and Additional Work
One round of revisions is included with each video order. Revisions are defined as minor edits such as: • Adjusting colors, backgrounds, or visual elements • Changing text or copy • Modifying pacing or timing • Re-recording voiceover with different emphasis or tone • Adding or removing captions Revisions do not include: • Significant creative changes or concept overhauls • Adding new animated scenes or sequences not in the original • Changing video format or orientation after delivery • Combining videos or creating entirely new videos Requests that go beyond one round of revisions, or involve substantial creative changes, may incur additional fees to be quoted by our team. We will inform you if a revision request falls outside the scope of included revisions. Revision requests must be submitted within 14 days of delivery. Requests submitted after 14 days may be treated as new orders.
6. Delivery Timeline
Pebble Animation will make reasonable efforts to deliver videos within 48 hours of order placement. However, this is an estimate, not a guarantee: • Delivery timelines may extend beyond 48 hours if you do not provide necessary information, assets, or approvals within a reasonable timeframe. • Delivery timelines may be extended during high-volume periods, holidays, or due to technical issues. • Videos are delivered via secure download link sent to your email address. • Your download link will remain active for 30 days; we recommend downloading promptly. Late delivery does not entitle you to a refund or credit unless Pebble Animation has materially breached these Terms. Time is not of the essence for delivery obligations.
7. Your Content & Intellectual Property Rights
Brand Assets You Provide: You own all brand assets you provide to Pebble Animation, including logos, images, footage, copy, scripts, and other materials. By providing these assets, you represent and warrant that: • You own or have the legal right to use all provided materials • Materials do not infringe on any third-party intellectual property, copyright, or trademark • Materials comply with all applicable laws and do not contain defamatory, libelous, or illegal content • You have obtained necessary permissions from any individuals featured in materials You agree that Pebble Animation may use your provided brand assets to create the ordered videos. Except as described under "Promotional and Portfolio Use" below, we will not use, repurpose, share, or retain your brand assets for any other purpose beyond creating your video and handling revisions. Finished Videos: Pebble Animation retains ownership of the creative work, animation, voiceover, and other creative elements we produce. You receive a limited, non-exclusive, royalty-free license to use the finished video for your personal, business, and marketing purposes (including social media posting, website use, and paid advertising). You may not: • Resell, redistribute, or sublicense the video to third parties • Use the video as a template, base, or starting point for derivative works • Claim ownership of the video or our creative work • Remove or alter any watermarks, credits, or attributions (if any) Promotional and Portfolio Use: You grant Pebble Animation a non-exclusive, worldwide, royalty-free license to reproduce, display, and distribute the finished videos we create for you — including your business name and logo as they appear within those videos — for our own marketing, promotional, and portfolio purposes. This includes displaying them on our website, on our social media accounts (including Instagram, TikTok, YouTube, Facebook, LinkedIn, and X), in paid advertising, in sales and pitch materials, and in showreels or compilations of our work. This license is limited to the finished videos and the brand elements visible within them. It does not permit us to publish your project questionnaire, your internal communications with us, unreleased product or pricing information, or any brand assets you provided that do not appear in the finished video. You may opt out at any time, before or after publication, by emailing hello@pebbleanimation.com. Upon request we will remove the video from channels we control within a reasonable period, though we cannot recall copies already downloaded, shared, or reposted by others. If your video contains confidential or unreleased information, or if you would prefer we not showcase it, please tell us at the time of ordering. Our Intellectual Property: All original creative work, concepts, animation, design elements, scripts, voiceovers, captions, and other content created by Pebble Animation remain our exclusive property. You may not use our creative work, production processes, scripts, or design elements for any purpose other than as licensed.
8. Acceptable Use & Content Restrictions
You agree not to use our Services for any illegal, unethical, or harmful purpose. Specifically, you may not: • Create videos for illegal purposes or to promote illegal activities • Create content that harasses, bullies, threatens, or incites violence against any individual or group • Create content that is defamatory, libelous, or violates anyone's privacy or publicity rights • Create false, fraudulent, or misleading claims or advertising • Create content that violates third-party intellectual property rights (including music, footage, or images) • Violate the terms of any platform you intend to post the video on (e.g., Facebook, Instagram, TikTok) • Use our Services to create competitive content that mimics or copies our work or processes We reserve the right to refuse service or terminate your account if we determine your content violates these restrictions. We are not responsible for how you use the finished videos or any legal consequences resulting from your use.
9. Limitations on Liability
TO THE FULLEST EXTENT PERMITTED BY LAW: • Pebble Animation IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. • WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. • WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. • IN NO EVENT SHALL Pebble Animation BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. • OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR OUR SERVICES IS LIMITED TO THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE THAT GAVE RISE TO THE CLAIM, OR $100, WHICHEVER IS LESS. Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you in full.
10. Indemnification
You agree to indemnify, defend, and hold harmless Pebble Animation, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from: • Your use or misuse of our Services • Content you provide or instruct us to create • Your violation of these Terms • Your violation of any applicable law or third-party rights • Claims that your brand assets or provided content infringe on third-party intellectual property This indemnification applies only to claims resulting from your conduct or content, not our conduct.
11. Privacy and Data Protection
Your use of our Services is also governed by our Privacy Policy, which you can review at /privacy. By using our Services, you consent to our collection, use, and sharing of information as described in the Privacy Policy. We take your privacy seriously and implement appropriate security measures to protect your personal information.
12. Representations and Warranties
You represent and warrant that: • You are at least 18 years old and legally able to enter into this Agreement • You have the authority to enter into this Agreement on behalf of your business or organization • All information you provide is accurate, complete, and truthful • You will not use our Services for any illegal or unauthorized purpose • You own or have the right to use all brand assets you provide • You will comply with all applicable laws and third-party rights when using our Services and finished videos
13. Termination
Pebble Animation may terminate or suspend your access to our Services immediately and without notice if: • You violate these Terms • You use our Services for illegal or harmful purposes • We believe termination is necessary to protect our business, users, or third parties • You engage in fraud, misrepresentation, or abuse of our Services Upon termination, all licenses granted to you are revoked, and you must cease using our Services. Termination does not affect your rights to videos already purchased and delivered.
14. Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflicts of law principles. Any disputes arising from these Terms or our Services shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction and venue of such courts. If either party brings a claim, they agree to attempt resolution through good-faith negotiation first. Absent resolution, either party may pursue legal action.
15. Severability
If any provision of these Terms is found to be invalid, unenforceable, or illegal, that provision shall be modified to the minimum extent necessary to make it valid, or if not possible, it shall be severed. The remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Pebble Animation regarding our Services and supersede all prior agreements, understandings, and negotiations. No course of dealing, course of performance, trade practice, or trade usage shall be used to modify these Terms.
